TasteTune · Brand Sound Design
This License applies together with the TasteTune International Terms of Service and any Individual Terms agreed for the project. If there is a conflict, the Individual Terms prevail first, followed by the International Terms and then this License.
Brand Sound Design License
1. Standard License
For a Brand Sound Design project that has been formally delivered, TasteTune grants the client, to the extent TasteTune is legally and contractually able to do so, a license to use the delivered work in the ordinary commercial activities of the contracted brand, venue, facility, or business.
Unless the Individual Terms state otherwise, the standard license is:
- Territory: worldwide
- Term: no fixed expiry
- Additional royalties: none
- TasteTune credit: not required
Unless expressly agreed otherwise, this is a license and not an assignment or transfer of copyright or other intellectual-property ownership.
2. Standard Permitted Uses
Ordinary brand uses include:
- in-store or in-venue playback and atmosphere
- official websites
- official social-media accounts
- YouTube and other brand video content
- advertising and promotional campaigns
- events, exhibitions, and presentations
- other ordinary promotional and operational uses for the contracted brand
3. Multiple Locations
Use at multiple locations directly operated by the same operating entity under the same contracted brand is included in the standard license.
The following require prior consultation and are not automatically included:
- franchisees
- separate legal entities
- sister brands
- materially different group-company operations
- another brand or business outside the contracted scope
4. Sharing With Contractors
You may provide the delivered files to a video-production company, advertising agency, social-media contractor, event contractor, or similar service provider solely as necessary for work performed for the contracted brand.
Those contractors receive no independent right to use the sound for themselves or for another client.
5. Practical Editing
For permitted brand uses, practical incidental edits may include:
- trimming duration
- fades
- volume adjustment
- looping
- synchronization to video
- comparable minor edits
A major restructuring, creation of a separate musical work, or another use beyond ordinary brand adaptation requires prior consultation.
6. Uses Requiring Prior Consultation or Approval
The standard license does not automatically include:
- stand-alone distribution or sale through Spotify, Apple Music, or another music-distribution platform
- special exclusivity
- major remixes or conversion into a separate musical product
- YouTube Content ID or another automated copyright-claim, fingerprinting, or rights-management system
- collective rights-management registration
- expanded use by franchisees, separate legal entities, or sister brands
7. Prohibited Uses Without Permission
You may not, without TasteTune's prior approval:
- sell, resell, redistribute, or sublicense the delivered sound itself
- register or provide it as stock music, reusable audio, a music template, or a similar reusable asset
- use it for an unrelated brand or business outside the licensed scope
- use it to train, fine-tune, or develop an AI or machine-learning music-generation system
- use it unlawfully or in a manner that infringes third-party rights
8. Exclusivity and Intellectual Property
TasteTune will not intentionally resell or redeliver the exact final sound delivered to you as another customer's commissioned final work.
However, because of the production methods and the nature of generative AI and other creative technologies, TasteTune does not guarantee:
- worldwide legal exclusivity
- that copyright or another proprietary right will arise in every jurisdiction
- complete absence of similarity to third-party works
- that the work is globally unique
Any license granted by TasteTune is limited to rights TasteTune is legally and contractually able to grant.
9. When the License Begins
The standard license becomes available after full payment of the agreed project fees and formal delivery of the contracted deliverables.
Direction samples, work-in-progress audio, and other pre-delivery material may not be publicly released, advertised, or commercially used unless TasteTune expressly permits that use.
10. Individual Terms
If TasteTune and the client agree to special usage rights, exclusivity, distribution terms, or another expanded scope in writing, those Individual Terms will prevail.
